Terms and Conditions

Please do not use our website or services if you disagree with any part of these Terms and Conditions.

 

The following Terms and Conditions have been prepared to help you make the most of Bee Charis.  Please take a few moments to read them thoroughly.

Agreement

1 Interpretation and Variation

1.1  In the Terms and Conditions the following definitions apply:

“Bee Charis” means Lisa Peelo trading as Bee Charis.

“Client” and "Participant" mean any person that has completed and submitted the health questionnaire and has been accepted by Bee Charis.

“Instructor” means any person who is employed by Bee Charis to deliver training.

"Studio" means any location or venue where training takes place.

“Terms and Conditions” means these terms and conditions.

“Website” means www.beecharis.com.

1.2  References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender.

1.3  The Terms and Conditions are incorporated into the health questionnaire and registration forms.

1.4  Bee Charis reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the training and the conduct of Clients.  Any such changes will be notified to Clients and, until revoked, are and will be binding for Clients.

1.5  The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

2 Booking and Cancellation

2.1  Class numbers are limited in order to ensure a high level of observation and correction.  Bookings are subject to availability.

2.2  All bookings must be placed in writing using the relevant registration form or system.  Places are not confirmed until forms and payment are received.

2.3  Receipt of payment renders the Client liable for payment of their full booking fees subject to the limitations contained under the cancellation below.

2.4  Full booking fees are payable regardless of whether the Client attends class.

2.5  If cancellation is received 24 hours prior to class commencing then the Client will be refunded by a credit to their class pass.

2.6  If cancellation is received less than 24 hours to class commencing then payment is non-refundable.

2.7  Late comers will not be able to enter once the class has begun for insurance purposes and in consideration of the Instructor and Participants.  Full booking fees are payable. 

2.8  Clients must participate in class by the expiry date noted on their class pass.  Extension to this period is on an individual review basis and Bee Charis is under no obligation to grant such requests.

2.9  In the rare event Bee Charis will need to cancel class the Client will be refunded by a credit to their class pass.

3 Fitness and Health

3.1  Clients are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition.  Bee Charis reserves the right to refuse access to any Client if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of its facilities.

3.2  Clients are required to follow the instructions of the Instructor at all times.

3.3  Clients are required to inform a member of staff if they incur injuries or changes to their condition after submitting their health questionnaire.

4 Safety and Hygiene

4.1  Bare feet are strongly advised, as not only better for the Client to feel the connection to the floor, but also he is less likely to slip.  If socks are required, non-slip socks with individual toes are strongly advised.  Any socks are worn at the Client's own risk.

4.2  Clients must not walk around the Studio barefoot if they have verrucae or similar foot complaints.  Please wear suitable socks or indoor flip-flops.

4.3  In the interests of safety and hygiene, no crockery or glass are permitted in the Studio.

4.4  No pets (with the exception of guide dogs) are permitted in the Studio.

4.5  Clients must use the main entrance to the Studio when entering or leaving the Studio.  Designated fire exits, which are clearly marked, are there in the interests of safety and Clients must not interfere with these exits for any reason.

4.6  In the event of a fire Clients are asked to make their way to the nearest available exit.

4.7  Smoking and vaping are forbidden in the Studio.

4.8  For online classes Clients will ensure there is a minimum of four-square-meters space per person to perform the exercises safely and move freely without obstructions, hazards and distractions.  Some considerations:  The flooring is even and comfortable for you to exercise on with a mat placed on top; Please remember the area above such as overhead light fittings; There is adequate lighting, ventilation, heating and hydration; and All pets are securely out of the way.

5 Apparatus and Equipment

5.1  The Client must wear suitable clothing free of any materials or embellishments that may damage the apparatus and equipment.  This includes but is not limited to zippers, buckles, buttons and studs.

5.2  The Client's skin and hair must be free of any products that may damage the equipment.  This includes but is not limited to jewelry, self-tanner, sun lotion and glitter.  Long hair must be tied back.

5.3  The Client will ensure his own equipment and props that will be used are well-maintained and in good working order.

6 Personal Belongings

6.1  Personal belongings are brought onto the Studio premises at the Client’s own risk and Bee Charis does not accept liability for any loss or damage whatsoever to such items.

6.2  Vehicles parked in the Studio car park are parked at the Client’s own risk and Bee Charis accepts no liability for any loss or damage whatsoever to such vehicle.

7 Limitation of Liability

7.1  Bookings are subject to availability.  Bee Charis reserves the right to cancel, withdraw, change or relocate a class within a reasonable time frame.  Bee Charis shall not be held liable for any loss of earnings or expenses as a result of such changes.

7.2  Travel, accommodation and loss of earnings resulting from the attendance of Bee Charis training are the full responsibility of the Client.  Bee Charis under no circumstances accept any liability for these costs.

7.3  Bee Charis cannot be held responsible for cancellations caused by circumstances outside of their control, including but not limited to weather, travel issues and strikes.  Bee Charis will make reasonable attempts to respond to such situations and achieve a satisfactory resolution.

7.4  It is the Client’s responsibility to ensure that he is capable of undergoing a routine of exercises provided by any programme which he follows or session which he attends.  Clients accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session.  Advice provided by Instructors at Bee Charis at no time constitutes medical advice in substitute for advice provided by a medical professional.

7.5  Bee Charis accepts no liability for loss or damage to property of Clients or for injury to Clients on the Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion.

7.6  In consideration of their participation in the activities and programmes of Bee Charis and the use of facilities and equipment owned and/or under the control of Bee Charis the Client hereby waives and releases Bee Charis and its Instructors from any and all responsibility or liability for injuries or damages resulting from their participation in any of the Bee Charis’s activities or use of Bee Charis’s equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of Bee Charis.

8 General

8.1  In the event of a full class with a waitlist, the Client must book a course ticket within the exclusive booking window to maintain his prioritized space in the class. All reasonable attempts will be made to provide the Client with supplementary training solutions if all course ticket dates cannot be attended.

8.2  Bee Charis reserves the right to eject any Participant from a class after an initial verbal warning with no obligation to reimburse booking fees.  Dependant on the nature of the incident reasonable attempts may be made to assist the Client in continuing with training.

8.3  Any class or event presented in person or online are the sole property of Bee Charis.  Bee Charis do not allow use of any content, material, filming or audio copies for any purpose other than the practice of the Client at the class or event.  Any duplication of all or part of the above mentioned items is in direct breach of copyright laws and will result in legal proceedings including full reimbursement of all legal costs incurred.

8.4  Bee Charis may, if a Client so wishes, communicate with the Client by electronic mail (“email”).  By providing an email address to Bee Charis, the Client consents to receiving email communications from Bee Charis, including notices pursuant to the Terms and Conditions.  The Client also accepts the risk that email may not be a secure and confidential means of communication.  Bee Charis will not be liable for any loss or damage suffered as a result of communicating with a Client by email.

8.5  Clients are required to give notice to Bee Charis of any change of email address.  Failing such notice, all communications will be assumed to have been received by the Client within five days of emailing to the last address notified to Bee Charis.

9 Company Information

9.1  Bee Charis is registered in England.
